1.1 About MrKanjoos
MrKanjoos is a social commerce platform owned and operated by Vibuddy Network Private Limited, incorporated under the Companies Act, 2013, with its registered office at P No.6 Datta Nivas, MIG-II, KHB Colony, Golageri road, Sindgi, Sindgi, Bijapur (KAR)- 586128, Karnataka ("Company", "MrKanjoos", "We", "Our", or "Us").

1.2 Purpose of Policy
This Privacy Policy describes how MrKanjoos collects, uses, shares, and protects personal information of:

  • Creators/Influencers/Sellers, who use the Platform to launch and manage their Stores;
  • Customers/Buyers, who purchase Products through the Platform; and
  • Visitors, who browse or interact with the Platform without registering.

1.3 Commitment to Privacy
We value your trust and are committed to protecting your personal data in compliance with applicable Indian laws, including the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDP Act).

1.4 Consent
By accessing, registering, or using the Platform, you consent to the collection, processing, storage, and disclosure of your personal data in accordance with this Privacy Policy. If you do not agree, you must discontinue use of the Platform.

1.5 Scope
This Privacy Policy applies to all Users of the Platform (Creators, Customers, and Visitors). It does not apply to third-party websites, applications, or services that may be linked to or integrated with the Platform.

2. Information We Collect

2.1 Information Collected from Creators/Influencers
When you register as a Creator or Seller on the Platform, we may collect:

  • Full name, age, gender, and contact details (email, phone number, address).
  • Identity documents (such as Aadhaar, PAN, Passport, or other government-issued ID) for KYC verification.
  • Bank account details for payouts and financial settlements.
  • Social media handles/links for verification of authenticity and eligibility.
  • Profile photos, logos, or branding information voluntarily provided for Store setup.

2.2 Information Collected from Customers/Buyers
When you purchase Products or interact with the Platform as a Customer, we may collect:

  • Full name, age, gender, delivery/billing address, phone number, and email address.
  • Payment details such as UPI ID, credit/debit card information, or net banking details (processed via secure third-party payment gateways).
  • Order history, purchase preferences, and transaction details. Reviews, ratings, or feedback submitted voluntarily.

2.3 Information Collected Automatically (All Users)
When you access or use the Platform, we may automatically collect:

  • Device information, operating system, and browser type.
  • IP address, geolocation (where permitted), and access logs.
  • Cookies, pixels, and tracking technologies (see Section 5 on Cookies).
  • Browsing patterns, clickstream data, and time spent on the Platform.

2.4 Sensitive Personal Data
Certain information, such as financial details (bank account, payment information) and identity documents, may be classified as Sensitive Personal Data under Indian law. Such data is collected only for legitimate business purposes (e.g., payouts, fraud prevention, and compliance with laws).

2.5 Optional Information
Users may voluntarily provide additional information (such as preferences, feedback, or survey responses). Such information will be treated as personal data under this Policy.

3. How We Use Your Information

3.1 To Provide Services
We use your personal information to:

  • Register and verify your Account.
  • Enable Creators to set up and manage their Stores.
  • Process Customer orders, payments, cancellations and replacements.
  • Facilitate payouts to Creators.
  • Provide customer support and resolve disputes.

3.2 To Ensure Security & Compliance

  • Verify identity and authenticity of Creators and Customers.
  • Detect, prevent, and investigate fraud, unauthorized access, or illegal activity.
  • Enforce our Terms & Conditions and other Platform policies.
  • Comply with applicable laws, tax obligations, and regulatory requirements.

3.3 To Improve the Platform

  • Monitor usage patterns and user behavior to enhance performance. Develop new features, products, and services.
  • Personalize content, recommendations, and user experience.

3.4 For Communication

  • Send important updates about your Account, transactions, and service changes.
  • Notify you about new features, promotional offers, or marketing campaigns (with the option to opt out).
  • Conduct surveys or request feedback to improve services.

3.5 For Marketing & Advertising

  • Analyze purchase patterns and preferences to deliver relevant promotions.
  • Use cookies, analytics, and tracking tools to measure advertising effectiveness.
  • Re-share or reference Creator promotional content (posted externally on social media) to market Stores and the Platform (with Creator consent, as per Section 10 of T&C).

3.6 For Legal Obligations

  • Retain and disclose data as required by law, legal process, or government authorities.
  • Respond to regulatory requests, tax audits, or law enforcement inquiries.

4. How We Share Your Information

4.1 With Service Providers
We may share personal information with trusted third-party partners who assist us in operating the Platform and providing Services, including but not limited to:

  • Logistics and courier partners (for product delivery and replacements).
  • Warehousing and inventory partners (for order processing).
  • Payment gateways and banking partners (for processing transactions and payouts).
  • IT service providers, analytics providers, and cloud hosting providers.

4.2 With Creators and Customers
Customer details will not be shared with Creators. MrKanjoos manages all logistics, delivery, and customer support directly, ensuring Customer privacy is fully protected. Limited Creator details (such as brand/store name, logo, or promotional content) may be displayed to Customers on the Platform for identification and marketing purposes.

4.3 For Legal and Compliance Purposes
We may disclose personal information if required to do so by law or in good faith belief that such disclosure is reasonably necessary to:

  • Respond to legal process, regulatory inquiries, or government requests.
  • Enforce our Terms & Conditions and protect the rights, property, or safety of MrKanjoos, its Users, or the public.
  • Prevent, detect, or investigate fraud, security breaches, or other unlawful activities.

4.4 In Case of Business Transfers
In the event of a merger, acquisition, reorganization, or sale of business/assets, your personal data may be transferred to the new entity, subject to the same level of protection as outlined in this Privacy Policy.

6. Data Security

6.1 Security Measures
We implement reasonable technical, organizational, and administrative safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. Measures may include encryption, firewalls, secure servers, access controls, and regular system audits.

6.2 Third-Party Service Providers
While we take care to engage only trusted third-party partners (such as payment gateways, logistics providers, and cloud services), we cannot guarantee the absolute security of data handled by third parties. Such providers are contractually obligated to maintain confidentiality and data protection standards.

6.3 User Responsibility
Users are responsible for maintaining the confidentiality of their login credentials, passwords, and account information. Any activity carried out under a User's account will be deemed authorized by the User.

6.4 Limitations
While we strive to protect your information, no security system is completely secure. MrKanjoos cannot guarantee absolute security of personal data transmitted through the internet and disclaims liability for breaches beyond its reasonable control.

7. User Rights

7.1 Access and Review

  • Users have the right to access and review the personal information held about them by MrKanjoos.
  • Requests for access may be submitted to the contact details provided in Section 12 (Contact & Grievance Officer).

7.2 Correction and Updates

  • Users may update or correct their personal details at any time through their Account settings or by contacting MrKanjoos support.
  • MrKanjoos will make reasonable efforts to ensure such corrections are reflected promptly.

7.3 Deletion and Deactivation
Users may request deletion or deactivation of their Account and associated personal data.

  • Such requests will be honored subject to legal, tax, and operational requirements (e.g., pending orders, payout settlements, or regulatory obligations).

7.4 Withdrawal of Consent
Users may withdraw consent for the use of their personal data for non-essential purposes (such as marketing communications) at any time by using the unsubscribe option or contacting support.

  • Withdrawal of consent for essential services (such as order processing or Creator payouts) may require termination of the User's Account.

7.5 Restriction of Access to Data
MrKanjoos ensures that Customer personal information is never shared with Creators.

  • All requests relating to order status, replacements, or complaints must be directed to MrKanjoos support channels only.

7.6 Right to Lodge Complaints
Users have the right to raise concerns with the Grievance Officer (see Section 12).

  • If unsatisfied, Users may escalate complaints to the relevant government authority under the Digital Personal Data Protection Act, 2023.

8. Data Retention

8.1 Retention Period
We retain personal information only for as long as it is necessary to fulfill the purposes outlined in this Privacy Policy, including providing services, complying with legal obligations, resolving disputes, and enforcing agreements.

8.2 Creators' Data
KYC documents, bank account details, and related Creator information may be retained for the duration of the Creator's association with MrKanjoos and for a reasonable period thereafter, as required by applicable tax and regulatory laws.

8.3 Customers' Data
Customer order details (such as name, contact, delivery address, and purchase history) will be retained for the period necessary to complete transactions, handle replacements, comply with tax/legal requirements, and maintain transaction records. No Customer data is shared with Creators at any time.

8.4 Automatic Deletion/Anonymization
Once the retention period expires, personal data will either be securely deleted or anonymized so that it can no longer be linked to an individual.

8.5 Exceptions
Certain data may be retained for longer periods where required by:

  • applicable law,
  • regulatory compliance, or
  • to protect against fraud, abuse, or enforcement of legal rights.

9. Children's Privacy

9.1 Eligibility
The Platform is not directed at or intended for use by individuals under the age of 18 years.

9.2 Parental/Guardian Consent
If you are under 18, you may use the Platform only with the active involvement and consent of a parent or legal guardian.

9.3 Data Collection from Minors
We do not knowingly collect, store, or process personal information from minors under 18 without parental/guardian consent. If we become aware that personal information of a minor has been collected without proper consent, we will take steps to delete such information promptly.

9.4 Creator and Customer Accounts
Creators must be 18 years or older to register and operate a Store on the Platform. Customers below 18 must use the Platform only through their parent's or guardian's account and under their supervision.

10. Cross-Border Data Transfer

10.1 Primary Storage in India
All personal data collected by MrKanjoos is primarily stored and processed on servers located within India.

10.2 Transfers Outside India
In certain cases, personal data may be transferred to and processed in countries outside India where our third-party service providers (such as cloud hosting, analytics, or payment processors) are located.

10.3 Adequate Protection
Where such transfers occur, we ensure that appropriate contractual, technical, and organizational safeguards are in place to protect your information, consistent with the requirements of the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable laws.

10.4 User Consent
By using the Platform, you consent to the transfer, storage, and processing of your personal data outside India, subject to the protections outlined in this Privacy Policy.

11. Changes to Privacy Policy

11.1 Right to Modify
MrKanjoos reserves the right to update, amend, or modify this Privacy Policy at any time, at its sole discretion, to reflect changes in business practices, legal requirements, or technology.

11.2 Notification of Changes
Significant changes will be communicated to Users through one or more of the following methods:

  • Updates published on the Platform;
  • Email, SMS, or push notification to registered Users;
  • In-app or dashboard alerts.

11.3 Effective Date
Unless otherwise specified, changes shall take effect immediately upon publication on the Platform. Continued use of the Platform after such changes constitutes your acceptance of the revised Privacy Policy.

11.4 User Responsibility
Users are encouraged to periodically review this Privacy Policy to stay informed about how their information is being handled. If you do not agree with the revised Privacy Policy, you must discontinue use of the Platform and request Account deletion.
